ABSTRAK Tinjauan Yuridis Pertukaran Informasi Data Potential Customer Secara Resiprokal Antara Entitas Utama dan Lembaga Jasa Keuangan Non Bank dalam Konglomerasi Lembaga Jasa Keuangan PT X Raditya Agung 110110110253 Perkembangan bisnis jasa keuangan di Indonesia ditunjukan dengan banyaknya lembaga jasa keuangan terutama bank, yang membentuk konglomerasi jasa keuangan dimana bank membuat anak perusahaan yang bergerak di berbagai bidang jasa keuangan. Fenomena ini akan meningkatkan perekonomian secara tidak langsung bagi Indonesia. Disisi lain, bila penerapan manajemen risiko dalam konglomerasi tidak diawasi dan berjalan dengan baik, akan menyebabkan keruntuhan ekonomi secara nasional. Dalam manajemen risiko terintegrasi, PT X menerapkan pertukaran data potential customer atau data nasabah antar lembaga jasa keuangan dalam konglomerasi PT X yang menimbulkan dampak negatif terhadap nasabah dari PT X. Tujuan dari penelitian ini adalah untuk melihat keabsahan pertukaran informasi data potential cutomer tersebut dan pelimpahan pertanggungjawaban terhadap dampak negatif yang dialami oleh nasabah PT X. Metode penelitian yang digunakan adalah yuridis normatif. Menekankan pada norma hukum disamping menelaah kaidah-kaidah hukum yang berlaku di masyarakat. Penelitian ini juga mengkaji bahan hukum primer, bahan hukum sekunder, bahan hukum tersier, dan kepustakaan elektronik. Metode ini digunakan dengan menganalisis proses pertukaran data potential customer yang terjadi dalam konglomerasi lembaga jasa keuangan PT X dengan kaidah hukum positif Berdasarkan hasil penelitian, dapat disimpulkan bahwa pertukaran informasi dalam konglomerasi PT X antara PT X sebagai entitas utama yang sekaligus berbentuk bank dengan lembaga jasa keuangan non bank bukan merupakan tindakan yang sah secara normatif serta dapat digolongkan sebagai perbuatan melawan hukum. Sedangkan untuk pertanggungjawaban atas pertukaran data potential customer dapat dilimpahkan secara tanggung renteng dimana PT X serta anak perusahaan PT X yang memiliki kewajiban untuk bertanggung jawab atas kerugian iv ABSTRACT Juridical Review on the reciprocal exchange of Potential Customer Data Between The Main Entity and the Non-Bank Financial Service Institution under PT X Financial Service Conglomeration Raditya Agung 110110110253 The growth and development of businesses in financial services in Indonesia can be seen by the amount of emerging financial institutions, especially banks that are expanding their businesses by forming a financial services conglomeration where banks create subsidiary institutions that are engaged in various areas of financial services. This phenomenon, on one hand, will indirectly boost the economy of Indonesia. On the other hand, if the application of risk management in the conglomeration is not applied and monitored properly it can cause the national economy to collapse. In applying risk management in the conglomeration which is reffered to as integrated risk management, PT X implements the exchange of potential customer data between subsidary institutions in PT X financial services conglomeration which had a negative outcome towards some of the customers of PT X itself. The purpose of this research is to see the validity of the exchange of the potential customer data and how the responsibility can be delegated towards the negative effects experienced by customers of PT X The research method that is being used is the normative juridical approach. This research eemphasizess on normative law while analyzing the rule of law that is applicable in society. This research was conducted reviewing primary legal materials, secondary legal materials, tertiary legal materials and through an electronic library. By utilizing this method, the writter analyzed the process of potential customer data exchange under PT X financial service conglomeration in comparison to the positive rule of law. Based on the results of this research, it can be concluded that the exchange of information within the PT X conglomeration between PT X as the main entity (in the form of a bank) with a non bank financial services institution can not be considered as a legitimate legal action and can be classified as a tort. As for the liability regarding the exchange of potential customer data; PT X and its subsidiary institutions may be held jointly responsible for the loss. v
