TINJAUAN YURIDIS DALAM PERDAGANGAN BERJANGKA KOMODITI (FOREIGN EXCHANGE) MELALUI ON-LINE TRADING SYSTEM (Studi di PT. Millennium Penata Futures Yogyakarta) INTISARI Oleh Siska Irawati1 , Zulkarnain Harahap2 Penelitian ini bertujuan untuk menunjukkan bahwa perjanjian yang dibuat dalam forex online trading telah memenuhi syarat sahnya perjanjian sesuai dengan Pasal 1320 KUHPer, yaitu adanya kata sepakat, kecakapan dalam membuat suatu perikatan, suatu hal tertentu dan sebab yang halal. Perjanjian dalam perdagangan forex secara online merupakan perjanjian pemberian amanat dengan jenis kontrak gulir yang telah memenuhi asas-asas hukum perjanjian, yaitu asas konsensualisme, kebebasan berkontrak, pacta sunt servanda, kepribadian dan beritikad baik. Selain telah terpenuhinya syarat sahnya suatu perjanjian pemberian amanat, transaksi forex online trading halal sebab telah sesuai dengan prinsip syariah, yaitu terpenuhinya rukun dan syarat jual beli sebagaimana Fatwa DSN MUI No. 28/DSN-MUI/III/2002 Tentang Jual Beli Mata Uang. Penelitian ini bersifat deskriptif-analitis dengan menggunakan pendekatan yuridis-normatif yaitu dengan mempelajari peraturan perundang-undangan yang berlaku serta melihat dari segi teori dan fakta-fakta di lapangan. Bahan hukum primer yaitu peraturan perundang-undangan yang terkait dengan objek penelitian, bahan hukum sekunder dikumpulkan melalui studi dokumen sedangkan bahan hukum tersier diperoleh dari makalah, jurnal dan lain sebagainya. Penelitian lapangan dilakukan di PT. Millennium Penata Futures Cabang Yogyakarta guna memperoleh informasi serta data mengenai pelaksanaan transaksi Perdagangan Berjangka Komoditi (PBK) yang dalam hal ini forex online trading. Berdasarkan hasil penelitian diperoleh kesimpulan bahwa pelaksanaan perjanjian nasabah atau pemberian amanat yang dibuat antara nasabah atau investor dengan pihak perusahaan telah memenuhi syarat sahnya perjanjian baik ditinjau dari segi peraturan perundang-undangan yang berlaku sebagaimana diatur dalam Pasal 1320 Kitab Undang-Undang Hukum Perdata dan Fatwa DSN MUI No. 28/DSNMUI/III/2002 Tentang Jual Beli Mata Uang. Transaksi forex online trading selain legal juga halal karena didalamnya tidak terdapat unsur riba, masyir dan gharar. Millennium Penata Futures Yogyakarta) ABSTRACT By: Siska Irawati3, Zulkarnain Harahap4 This research was aimed to show that the agreement established in futures online trading had fulfilled agreement conditions according to Article 1320 of KUHPer i.e. there was an agreement, competency in establishing an agreement, a specific subject and a legal cause. The agreement in an online forex trading was an agreement of providing mandates with delivery contract that had fulfilled agreement legal principles i.e. concensualism principles, contracting freedom, pacta sunt servanda, personality and god will. Besides, it had been fulfilled conditions of an agreement, mandates providing agreement in online forex trading and also had been according to sharia principles i.e. the fulfillment of trading conditions according to Instruction of National Sharia BoardIndonesian Council of Ulama No. 28/DSN-MUI/III/2002 about Foreign Exchange. This was a descriptive-analytical research using a jurisdiction-normative approach i.e. by learning regulations applied and also viewed from theory facets and field facts. A primary legal material namely the regulations related to research objects, secondary legal material was gathered through a documentary study, while tertiary legal material was obtained from essays, journals etc. The field research was conducted at PT. Millennium Penata Futures of Yogyakarta Branch to obtain information and also data on Commodity Future Trading (PBK) transaction implementation i.e.3 online forex trading. Based on the research results, it could be concluded that client agreement or mandate delivery was established between client or investor and company party that had fulfilled agreement legalities‟ conditions both viewed from regulation facets applied as regulated in Article 1320 of Civil Laws and Instruction of National Sharia Board-Indonesian Council of Ulama No. 28/DSN-MUI/III/2002 about Foreign Exchange. An online forex trading was legal due to there was no riba, masyir and gharar elements.
